Terms & Conditions

You must be 18 or over to order from us, and you must have legal capacity to enter a contract. If you are under 18, ask an adult to order on your behalf.

We currently ship to Australia and New Zealand only. Orders with a delivery address outside those countries will be cancelled and refunded.

Placing an order is an offer to buy. A contract is formed only when we send you a shipping confirmation — an order confirmation email is an acknowledgement, not an acceptance.

We may decline or cancel an order where:

• the product is out of stock;
• there is an error in the price or product description;
• we suspect fraud or a breach of these terms; or
• we cannot deliver to your address.

If we cancel an order you have paid for, we refund you in full to your original payment method.

• Prices are in Australian dollars (AUD) and include GST where applicable.
• Shipping is calculated at checkout and shown before you pay.
• We may change prices at any time, but a change never affects an order we have already accepted.
• Payment is taken at the time of order through our payment providers. We do not store your full card details.
• If a product is listed at an obviously incorrect price, we will contact you before shipping and give you the choice of paying the correct price or cancelling for a full refund.

We aim to dispatch within 1–2 business days. Delivery estimates shown on the site are estimates, not guarantees, and depend on the carrier.

Risk in the goods passes to you on delivery. If a parcel is lost or damaged in transit, contact us — we resend or refund at your choice.

Monthly deliveries run through Shopify Subscriptions.

• By starting a subscription you authorise us to charge your payment method on the recurring schedule shown at checkout, until you cancel.
• We email you before each renewal.
• You can pause, skip, reschedule or cancel at any time from your account or by emailing us.
• Changes take effect if made at least 48 hours before the next scheduled charge.
• If we change the price of a subscription, we will tell you at least 14 days in advance, and you can cancel before the change applies.
• Cancelling stops future charges. It does not refund orders already shipped, but your rights under the consumer guarantees still apply to every delivery.

Our Returns & Refunds policy forms part of these terms, including our 30-day money-back guarantee and your rights under the consumer guarantees.

Breathy products are external-use consumer products. They are not medicines and not medical devices, and we do not present them as treating, curing or preventing any condition.

Please follow the instructions on the pack. In particular:

• External use only. Single use, up to 12 hours.
• Do not use on broken, irritated or sunburnt skin.
• Not for children under 5.
• Do not use mouth tape if you cannot breathe freely through your nose, or after alcohol or sedatives.
• Stop using the product if you experience skin irritation.
• Not a treatment for sleep apnoea. If you snore heavily, stop breathing during sleep, or wake unrefreshed, speak to a doctor.

If you have a health condition or any doubt about whether a product suits you, speak to your pharmacist or doctor before use. Nothing on our site is medical advice.

All content on usebreathy.com — text, images, logos, packaging design, video — is owned by us or licensed to us. You may view and share it for personal, non-commercial use. You may not copy, reproduce or use it commercially without our written permission.

"Breathy" and our logo are our trade marks.

If you send us a review, photo, video or comment:

• you confirm it is your own honest opinion and experience;
• you confirm you own it or have permission to share it; and
• you give us a non-exclusive, royalty-free licence to publish and use it in our marketing, with attribution to your first name unless you tell us otherwise.

We may decline or remove content that is misleading, offensive, makes health claims we cannot substantiate, or infringes someone else's rights. We do not edit reviews to change their meaning, and we do not remove a review simply because it is negative.

We take care with our product information, but descriptions, images and availability can contain errors. Colours can vary between screens. Where an error is material, we will tell you before shipping and give you the option to cancel.

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. Nothing in these terms excludes, restricts or modifies those guarantees.

To the extent the law allows, and other than as required by those guarantees:

• our liability for a failure to comply with a consumer guarantee is limited, at our option, to replacing the goods, supplying equivalent goods, or refunding the price paid; and
• we are not liable for indirect or consequential loss.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, or for fraud.

How we handle your personal information is set out in our Privacy Policy, which forms part of these terms.

We may update these terms. The version that applies to your order is the one published when you placed it. We show the date of the latest update at the top of this page.

These terms are governed by the laws of New South Wales, Australia, and you and we submit to the non-exclusive jurisdiction of its courts. If you are a consumer in New Zealand, you keep the benefit of any mandatory protections under New Zealand law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986.
